Liberal vs. Conservative Interpretations of the Constitution

Two of the main schools of thought on Constitutional Law scholarship that are still relevant to this day are the Conservative and Liberal schools of thought.

The Conservative school of thought tends to believe that when trying to interpret the Constitution it is important to emphasize the beliefs that the Founding Fathers had at the time of the signing of the Constitution. The Conservative school of thought also tends to have a stricter interpretation of the wording of the Constitution and believes in limited government. It would not be stretch to say that Conservatives tend to see the Constitution as a Bible, with the Founding Fathers as prophets. Conservatives tend to view so-called “activist judges,” that is judges that have a set agenda, with scorn and distrust.

The Liberal interpretation of the Constitution tends to be more flexible and open to interpretation. Liberals tend to see the Constitution as a living document, that is something that can evolve and change with the times. The Liberal school of thought also stresses the importance of individual liberties and has faith in the judicial system.

There are strengths and weaknesses to both schools of thought, but I tend to believe that the Liberal interpretation is the better one. The Conservative school of thought tends to idolize the Founding Fathers too much, to the point where the Founding Fathers undergo the process of deification. Conservatives tend to forget that the Constitution is a document that was not written by Prophets, but by regular men who had flaws. Thomas Jefferson, George Washington, and other Founding Fathers were slave owners and far from perfect as human beings.

This idolization of the past is dangerous since it prevents the evolution of our country from taking place. I find that the deification of the Founding Fathers in itself is an extremely dangerous interpretation not just of the Constitution, but history in general. By believing that America is the “city upon the hill” it leads people to believe they are superior to others and ferments the idea of American Exceptionalism. This belief in turn leads to the resentment of other countries who do not appreciate when America acts superior to that of other countries.

The Liberal school of thought is a more valid interpretation since it sees the Constitution as something that must be more interpreted as time goes by. The society of today is vastly different from the times of the Founding Fathers and the Constitution should be viewed differently for different eras.

  2. You made an EXTREMELY single sided argument. What you do not say is that we are a free nation today due to the fact we are a constitutional republic. The danger of reinterpreting it is that you can interpret the rights completely away from American citizens.

    This is why the right believes in a much more literal sense. They take rights seriously whereas the left often see rights as being in the way to forming a centrally planned society.

    You also make a HUGE straw man argument that the founders were just mere men and there was immorality in the document itself namely slavery and then insinuate that the right believes it like a religion so it must be so. The right does not believe in the in this. There is a system in place that allows it to change to embrace new realities while protecting the freedom of the people. It is called the amendment process. They believe rights are so important that 3/4ths of congress need to agree that a change needs to be made and that has happened 27 times.

    One last thing. The right believes the rights of the people are important. The left holds value in rights but it believes that social justice supersedes rights. Social justice is the taking away of rights to make things more equal in outcome. This of course does not always hold true as the right does pursue moral legislation but in general, comparing the right and left, the right is far more concerned with rights that the left.

    1. "Unknown" I agree. Conservatives do not view the Constitution as a "Bible" and infallible. What we do believe is that you can't change the original meaning of the Constitution ever! You can amend it, which we have done many times before. The amendments give it new meaning. We need any change to this formative document to be done by 3/4 majority, not activist judges.

Typical public school indoctrination blog there...wow u really need to look into philosophy and the mind set of not just the foundes but also from the great minds of the time that helped inspire them great men who made an amazing government system and under that outstanding constitution a near perfect government started resulting in the creation of the most ideal environment to succeed and from that came the birth of the greatest empire in all of human history..it was the fastest rise to the greatest economy ever known we became the strongest the smartest the richest the most advanced ever we became the standard in how to form a government... now where America started to decline in supremacy and allowed othe countries to start to catch up to us was when liberal progressive ideology realized that they could use equality from the bases of the 14th amendment to fundamentally change our great system into an all controlling globalized society that makes everyone and everything equal no matter what slowly stalling our economy until there is only 2 classes of people the ones in government doing good telling u exactly what to do and how to act and then there is the hard working class of America and they have no choice but to settle and except that wages will drop work becomes harder to find their taxes rise with nothing to show for it...now our founding fathers saw the constitution one day being out dated so they implemented ways for government to b able to adapt to the times the best way they could while still preventing the foundation that could one day b used to change and control and reshape and the very principles and values that our founders used to grow the greatest empire of all times
